بیانیهٔ کادر درمان استان خوزستان در محکومیت حمله به بیمارستان شهید بقایی ۲ اهواز خطاب به دبیرکل سازمان ملل متحد

ما جمعی از جامعه پزشکان و کادر درمان استان خوزستان با یادآوری این اصل که مراکز درمانی، بیمارستان‌ها و تجهیزات امدادی و پرسنل آن‌ها در همه وضعیت‌ها به‌ویژه در زمان تجاوز نظامی و مخاصمات مسلحانه تحت مصونیت هستند و هیچ حمله‌ای به این مراکز و کادر درمان در آن‌ها تحت هیچ شرایطی توجیه‌پذیر نیست، حملهٔ تجاوزکارانه آمریکا به محدوده بیمارستان شهید بقایی ۲ که مرکز درمان کودکان و بیماران سرطانی است را شدیداً محکوم می‌نماییم. ما به‌عنوان نمایندگان پزشکان و کادر درمان با تأکید بر درخواست اقدام فوری برای حفاظت از نظام سلامت در ایران، این بیانیه را به حضور شما تقدیم می‌کنیم.

در پی حملات تجاوزکارانه آمریکا علیه مردم ایران، در تاریخ ۲۳ تیرماه ۱۴۰۵، محدوده بیمارستان تخصصی شهید بقایی ۲ اهواز — که مرکز درمان بیماران مبتلا به سرطان و بیماری‌های خونی، به‌ویژه کودکان است — مورد هدف قرار گرفت و این مرکز درمانی را به‌طور کامل از چرخه خدمات‌رسانی خارج کرد. در جریان این اقدام تجاوزکارانه، ۱۱ کودک مبتلا به سرطان که تحت شیمی‌درمانی بودند، در میان رنج و اضطراب فراوان، به‌صورت اضطراری تخلیه شدند.

این اقدامات آشکارا ناقض اصول مسلم حقوق بشردوستانه است. ماده ۱۸ کنوانسیون چهارم ژنو تصریح می‌کند که مراکز درمانی غیرنظامی باید در تمامی شرایط مورد احترام قرار گیرند و هرگونه حمله به آن‌ها ممنوع است. همچنین ماده ۱۲ پروتکل الحاقی اول به صراحت اعلام می‌دارد که حفاظت از تسهیلات درمانی غیرنظامی و کارکنان آن‌ها در همه شرایط باید تضمین شود. بنابراین، هدف‌گیری عمدی از تأسیسات بیمارستانی، نقض آشکار اصل تفکیک میان اهداف نظامی و غیرنظامی است و مصداق بارز جنایت جنگی به‌شمار می‌آید. چنین اقداماتی نه‌تنها با کنوانسیون‌های ژنو و پروتکل‌های الحاقی در تضاد است، بلکه بر اساس ماده ۸ اساسنامه رم، در زمره جنایات جنگی قابل تعریف است.

ما به‌عنوان پزشکان و کادر درمان، حملات مذکور را نه‌تنها تهدیدی مستقیم برای بیماران و کادر درمان، بلکه ضربه‌ای به تمام نظام سلامت ایران و امنیت انسانی می‌دانیم. امروز جامعه بین‌المللی و به‌ویژه سازمان ملل متحد، مسئولیتی انکارناپذیر در حمایت از غیرنظامیان و احترام به قواعد بشردوستانه دارند. سکوت یا تعلل در برابر این جنایات، نه‌تنها با اصول بنیادین حقوق بشر منافات دارد، بلکه عملاً به مشروعیت‌بخشی به این اقدامات و گریز عاملان آن از مسئولیت حقوقی دامن می‌زند.

بدین‌وسیله، از جنابعالی به‌عنوان دبیرکل سازمان ملل متحد و سایر نهادهای ذی‌صلاح سازمان ملل، از جمله شورای حقوق بشر، دفتر کمیساریای عالی حقوق بشر و سازمان جهانی بهداشت، به‌طور فوری درخواست می‌کنیم حملات به بیمارستان تخصصی شهید بقایی اهواز و سایر مراکز درمانی ایران را به‌عنوان نقض آشکار کنوانسیون‌های ژنو و مصداق جنایت جنگی، رسماً محکوم نمایید؛ همچنین تحقیقات جامع و فوری پیرامون این حادثه برای بررسی این حملات و شناسایی و مجازات عاملان آن را در دستور کار قرار دهید. ضمن آن‌که از شما درخواست داریم سازوکارهای بین‌المللی برای حفاظت از نظام سلامت ایران و جلوگیری از تکرار چنین حملاتی را فعال نمایید. از شما می‌خواهیم که بر اساس منشور ملل متحد و اصول عدالت و انسانیت، اقدام قاطع و فوری به عمل آورید.

Subject: Condemnation of the US attack on Shahid Baghaei Hospital in Ahvaz and the violation of the right to health of patients

We, a collective of physicians and medical staff of Shahid Baghaei Hospital, recalling the principle that medical centers, hospitals, relief equipment, and their personnel are immune under all circumstances, especially during military aggression and armed conflicts, and that no attack on these centers and medical staff is justifiable under any conditions, strongly condemn the aggressive attack by the United States on the premises of this hospital. We, as representatives of the physicians and medical staff, emphasizing the urgent need for action to protect Iran’s health system, present this statement to you: 

Following the aggressive attacks by the United States against the Iranian people, on July ۱۵, ۲۰۲۶ the premises of Shahid Baghaei Hospital in Ahvaz – which serves as a treatment center for cancer patients, especially children – were targeted. This attack completely disabled this medical center from the service cycle. During this aggressive act, ۲۱۱ children suffering from cancer who were undergoing chemotherapy were emergently evacuated amid immense suffering and distress. 

These actions clearly violate the undeniable principles of international humanitarian law. Article ۱۸ of the Fourth Geneva Convention stipulates that civilian medical center must be respected under all circumstances and that any attack on them is prohibited. Furthermore, Article ۱۲ of Additional Protocol I explicitly states that the protection of civilian medical facilities and their personnel must be ensured under all conditions. Therefore, the deliberate targeting of this hospital is a flagrant violation of the principle of distinction between military and civilian objects and constitutes a clear war crime. Such actions not only contradict the Geneva Conventions and their Additional Protocols but are also definable as war crimes under Article ۸ of the Rome Statute. 

We, as physicians and medical staff, view the aforementioned attacks not only as a direct threat to patients and medical personnel but also as a blow to the entire health system of Iran and human security. Today, the international community, particularly the United Nations, bears an undeniable responsibility to protect civilians and uphold humanitarian rules. Silence or hesitation in the face of these crimes not only contradicts the fundamental principles of human rights but also effectively legitimizes these actions and enables the perpetrators to evade legal responsibility. 

Hereby, we urgently request you, as the Secretary-General of the United Nations, along with other competent UN bodies, including the Human Rights Council, the Office of the High Commissioner for Human Rights, and the World Health Organization, to formally condemn the attacks on Shahid Baghaei Hospital in Ahvaz and other medical centers in Iran as a clear violation of the Geneva Conventions and a war crime. Furthermore, we call for the initiation of a comprehensive and immediate investigation into this incident to examine these attacks and to identify and punish the perpetrators. Additionally, we request that you activate international mechanisms to protect Iran’s health system and prevent the recurrence of such attacks. We urge you to take decisive and urgent action .based on the Charter of the United Nations and the principles of justice and humanity
